Playvivi App Terms of Use

These Terms govern access to and use of the Playvivi mobile app (hereinafter “App”).
By using the App, the user declares that they have read, understood and accepted these Terms of Use.

1. App owner

2. Service description
   Playvivi is a digital application that allows users to access:
   • cultural and informational content
   • interactive experiences
   • augmented reality (AR) content
   • geolocated points of interest
   • routes and multimedia content relating to physical places
   The App is designed to offer experiences of a cultural, educational and entertainment nature.

3. Access to content
   The App may allow access to certain content or experiences through:
   • QR code scanning
   • entering access codes
   Such codes may be associated with access passes or tickets purchased through external channels.
   The App does not directly handle the sale of tickets or services.
   The user is responsible for the proper use of access codes and undertakes not to:
   • duplicate them
   • share them unlawfully
   • use them in breach of the applicable access conditions.
   Immerso S.r.l. reserves the right to restrict or revoke access to content in the event of improper use.

4. Access to physical locations and cultural sites
   Some points of interest, content or experiences in the App may be located within:
   • museums
   • archaeological sites
   • natural parks
   • regulated areas
   • paid-access locations
   The App does not guarantee free or unrestricted access to such places.
   The user is responsible for:
   • checking any access conditions
   • purchasing any required tickets
   • abiding by the rules and regulations of the places visited.
   Immerso S.r.l. is not responsible for any limitations, restrictions or changes to the access conditions of the sites.

5. Use of augmented reality and safety
   The App may use augmented reality (AR) technologies that require use of the device camera and interaction with the real environment.
   When using the App, the user undertakes to:
   • pay attention to their surroundings
   • use the App in safe conditions
   • avoid behaviour that may put themselves or others at risk.
   Use of the App while moving around or carrying out activities in real environments is entirely at the user’s own risk.
   Immerso S.r.l. is not responsible for:
   • accidents
   • damage
   • careless behaviour
   • hazardous situations arising from use of the App.

6. App content
   The content present in the App is for informational, cultural and entertainment purposes.
   Although Immerso S.r.l. undertakes to provide accurate information, it does not guarantee that the information will always be up to date, complete or free from errors.
   Immerso S.r.l. is not responsible for:
   • changes in opening hours
   • closures of places
   • route changes
   • territorial conditions
   • external events beyond its control.

7. Intellectual property
   All content present in the Playvivi App is owned by Immerso S.r.l. or licensed to it.
   The following are protected by copyright and intellectual property laws:
   • app software
   • AR content
   • 3D models
   • animations
   • audio
   • video
   • text
   • graphics
   • interactive elements
   • digital experience design.
   It is forbidden to:
   • copy
   • modify
   • distribute
   • reproduce
   • use commercially
   any content of the App without the written authorisation of the owner.

8. Photos with augmented reality elements
   The App may allow users to take photographs that include augmented reality elements.
   The images generated:
   • are saved exclusively on the user’s device
   • are not stored on the App’s servers.
   The user may use such images for personal use, including sharing on social networks.
   It is forbidden to use such images for commercial purposes without authorisation from Immerso S.r.l., as the AR elements remain the property of the owner.

9. Limitation of liability
   The App is provided “as is” and “as available”.
   To the extent permitted by law, Immerso S.r.l. shall not be held liable for:
   • direct or indirect damage arising from use of the App
   • service interruptions
   • technical malfunctions
   • incompatibility with devices
   • data loss
   • improper use of the App by users.

10. Changes to the service
    Immerso S.r.l. reserves the right to:
    • modify
    • update
    • suspend
    • discontinue
    all or part of the App’s functionality, without notice, for technical, security or service development reasons.

11. Minimum age
    Use of the App is permitted for users aged 14 or over.
    Underage users must use the App under the supervision of a parent or legal guardian.

12. Governing law
    These Terms of Use are governed by Italian law.

13. Jurisdiction
    For any dispute relating to the interpretation or application of these Terms of Use, the Court of Salerno shall have exclusive jurisdiction.
